Alcohol laws in Kernev

The Kernevic laws regulating alcohol use and sale are mostly focused on youth protection. The legislation varies substantially depending on the type and strength of alcohol.

Drinking age

Underage drinking in private is broadly legal. However, parents and legal guardians maintain a responsibility to protect children from physical or mental harm under the Child Protection Laws. Whilst discretion is allowed for the provision of alcohol by parents for children, under the age of twelve this is often considered to be neglectful.

The legal drinking age in Kernev is regulated under § 2 Lagha an Las:

§ 2 Alcoholic drinks
(1) In all premises licenced for the sale of alcoholic

  1. Cider below and up to 6%ABV, must not be sold to Children and Adolescents below the age of 15 years,
  2. Cider above 6%ABV, beer, wine, wine-like beverages or sparkling wine or mixtures of beer, wine, wine-like beverages or sparkling wine and soft drinks, must not be sold to Children and Adolescents below the age of 17 years,
  3. other alcoholic drinks or food items that contain other alcoholic drinks in more than insignificant quantities must not be sold to Children and Adolescents,

nor must their consumption by said persons be tolerated.

(2) Sub-Clause 1, No. 1 shall not apply to Adolescents accompanied by a Custodial Person.

In Tirol this means there are three drinking ages depending on the type of alcoholic beverage and the circumstances:

  • At 14 – minors are allowed to consume and possess cider in public places, bars or restaurants, as long as they are in the company and have the permission of a custodial person.
  • At 15 – minors are allowed to consume and possess cider up to and including 6% ABV in public places, bars or restaurants without their parents or a custodian.
  • At 17 – minors are allowed to consume and possess undistilled alcoholic beverages, such as beer and wine, and cider above 6%ABV, in public places, bars or restaurants without their parents or a custodian.
  • At 18 – adults are allowed access to distilled spirits, beverages containing distilled spirits, and food products containing non-negligible amounts of distilled spirits.
