The Second Sequoyan Constitution was created and ratified by the Second Sequoyan Constitutional Convention after the first constitution was declared invalid by the Treaty of Asequi. The Second constitution offered significantly more rights to the tribals and established new provinces within Sequoyah. It is the governing document of Sequoyah. It was put in practice on 9/18/2020.

Text of the Constitution

We, the various peoples of Sequoyah, to promote unity, welfare, and liberty, do hereby ordain this constitution to govern our nation for as long as providence allows.

Article 1

Sequoyah will be divided into seven autonomous provinces: Eastern Sequoyah Western Sequoyah Cheyenne Itse Gadu Itse Ulagohisdi Arapaho Itse Amequohi. Each province may ordain whatever provincial government it sees fit, so long as it establishes and defends the rights and responsibilities of its citizens (as defined by this constitution and the Federal government) within the province. Provinces have the power to limit migration to their province unless overridden by the Federal government. Provinces may regulate commerce within their province, levy taxes, create legislation and arm a militia. No province shall create an army unless in times of invasion or rebellion. Provincial constitutions must be approved by 51% of a popular vote within the respective provinces. Such constitutions can be amended or altered by a provincial referendum with the consent of 2/3 of Sequoyan citizens within such provinces. Each province must have a constitution in effect by October 25th, 2020.

Article 2

The Federal Government of Sequoyah will be made up of an executive and a legislative branch. The Legislative branch shall be made up of two houses: The Senate and the People's Assembly. Each province may send two senators, to be determined by their provincial governments, to the senate. A term for a senator is 4 years. The People's Assembly will contain one Assemblyman for every 20,000 Sequoyan citizens. A term for Assemblymen shall be 2 years. Assemblymen shall be elected by popular vote within their districts by the citizens they will represent. A national census shall be collected every 10 years to determine the districts and number of Assemblymen for the next decade. The Legislative branch, by the consent of the majority, may levy taxes, accumulate debt, create criminal penalties and pass any legislation deemed necessary and proper for the regulation of interstate commerce, defense of the nation, protection of liberty, or other necessities as the times demand. Such legislation that has earned the majority consent of both houses will be passed to the Executive, who may approve it or veto it. The Executive must either accept or reject any legislation within a period of 5 days. Any legislation not accepted or rejected within five days shall be considered accepted and be executed. The Executive will be compromised of a President, elected by the general population of Sequoyan citizens every 4 years, with all Sequoyan elections to be held on October 30th or any other date that shall be set forth by the unanimous consent of the legislature. The President may appoint any officers to oversee his departments so long as they serve with the majority consent of the Senate. The President may create new offices and departments under the jurisdiction of his office with the consent of both legislative houses. The President shall serve as head of state and will appoint a Supreme Commander of the Sequoyan armed forces, to be approved by a simple majority of the Senate. The Legislature has the power to declare war by a simple majority of both houses. The Supreme Commander will serve a term of four years, unless in times of war or rebellion, when the legislature may, by 2/3 majority, extend the term of the Supreme Commander until the end of such conflict. The Supreme Commander shall have direct command over all Sequoyan militias and military forces. His orders shall be considered supreme in military affairs. However, any orders that violate federal law or this constitution shall result in a trial of impeachment. All executive and military officers, including the President and the Supreme Commander, may be subject to impeachment and removal from office. With the consent of the President and a simple majority of the legislature, the nation of Sequoyah may enter into treaties with foreign powers. Such treaties shall be regarded as supreme over any other legislation passed by the Sequoyan congress unless the treaties are invalidated by a 2/3 majority of the legislature and the consent of the President.

Article 3

The President may appoint judges, to be approved by the Senate, to interpret the laws and this constitution and to hear civil suits and criminal cases. All criminal cases have the right to be heard by a jury. No jury shall be made up of any single race. A hierarchy of judges will exist, so that some judges will serve on the provincial level, some will serve on the federal level, and some will serve in the Supreme Court. The Federal and Supreme Courts shall have appellate jurisdiction over their lower courts. Judges shall serve until the end of their lifetime or retirement, but may be removed from office in cases of impeachment.

Article 4

Impeachment and removal from office may occur in any case deemed necessary and proper by 3/4 of both houses of the Sequoyan legislature. At any time an officer or judge is impeached by one house and removed from office by both houses his duties shall be terminated and his office shall be held left vacant or held by an interim officer as determined by simple majority of congress, until the President shall nominate a new officer. In the case that the President can no longer serve, the Supreme Commander will become President and appoint a new Supreme Commander to serve the remainder of his term. In the case that the Supreme Commander can no longer serve, the President shall appoint a new Supreme Commander to fill out the remainder of his term.

Article 5

All peoples born in the state of Sequoyah or having been a resident of Sequoyah for 10 years shall henceforth be considered Sequoyan citizens. Sequyoan citizens over the age of 16 shall have the right to bear arms, the freedom of speech and religion, the right to privacy, the right to habeas corpus, and the right to vote in Presidential and Assembly elections, regardless of the position of birth or past servitude. Any action taken by a Government or private entity to deprive a Sequoyan of these rights shall be considered criminal and investigated by the Executive branch and the Judiciary.

Article 6

The military of Sequoyah shall be maintained and funded by the consent of the Sequoyan legislature. The Supreme Commander may make a recommendation of the necessary funding for the military once a year to be accepted or rejected by Congress. Militias shall be maintained by their respective Provincial governments.

Article 7

The debts of all provinces shall henceforth be considered the debts of the Sequoyan federal government.

Article 8

At any time when the Sequoyan legislature is not in session, the President or Supreme Commander may call an emergency session, of which a majority of legislators must attend.

Article 9

This constitution may be amended with the consent of 2/3 of the legislature and 2/3 of the provincial governments.

Article 10

This constitution and the laws and treaties passed by the Sequoyan legislature and approved by the President (so long as they comply with this constitution) shall be considered the supreme law of the land. The Judiciary has the power to review all laws passed by the Sequoyan legislature or actions taken by provincial governments and may invalidate such laws ruled unconstitutional.

Article 11

New provinces may be created at any time deemed necessary by a 3/5 majority of the legislature. Any additional territories not considered provinces will be overseen by territorial governors appointed by the President.

Article 12

This constitution is considered ratified and in effect, passed with the consent of a majority of the second Sequoyan constitutional convention. Elections shall be held on October 30th of this year, 2020, to determine the offices of the President and the assembly. Senators shall take office be chosen by provincial governments on October 30th. All officers elected at any time shall begin their term of office on December 26th. Interim President Adama shall hold the powers of President and Supreme Commander until the newly elected officers take their oaths of office.
