Abortion in Gjorka is regulated by the Health of Women Act 2007. Abortion in Gjorka is allowed for a broad variety of reasons. In the case of risk to life to the Woman's life an Abortion is allowed at any time. In cases where the pregnancy is caused by Rape or Incest, or if the fetus has defects Abortion is allowed until 26 weeks into the Pregnancy. All other cases of Abortion are allowed upon request for the first twelve weeks of the pregnancy if approved by the Department of Health. The Department has very lenient requirements for terminating a pregnancy, and generally only require the applicant to prove conditions are no longer suitable for the fetus once born. This can include socioeconomic factors, physical or mental health, or simply lack of desire for a child. Abortion is legal at anytime for a minor who is pregnant. Abortion on grounds of risk to life, fetal defects and rape is protected under the 7th Amendment of the Constitution of Gjorka.

Abortion was completely illegal in Gjorka (with varying enforcement) from much of it's history until 1936 when President Ciara de Valera legalized it in cases of risk and rape. She even went so far at to codify into law, a rarity for Presidents in the Second Gjorkan Republic. Abortions remained accessible under these two circumstances until 1972 when the military dictatorship was overthrown in the Black Revolution. Abortion was legalized in cases of risk to life, fetal defects, rape and incest in the 7th Amendment of the new constitution. President Milhous instituted barriers to getting an Abortion during his presidency in order to discourage it, and even attempted to outlaw abortion outright on three occasions. Following the collapse of the Third Gjorkan Republic, Abortions remained constitutionally protected under the 7th Amendment of Constitution of the Federation of Gjorka. Then in 2007, President Joe Wallace passed the Health of Women Act 2007 which legalized Abortion in almost any case for the first twelve weeks of Pregnancy and extended the deadline to 26 weeks for fetal defects and rape/incest.

In modern day, support for expanding or lowering access to abortions remain largely unpopular with the Gjorkan public while keeping current access to abortions remains extremely popular with 70% approval. Both of Gjorka's major parties, Forward Gjorka and Gjorka United, support maintaining the current laws along with the Gjorkan Pirate Party, and the Freedom Party. The Green Party supports removing the approval of the Department of Health for abortions, and allows for abortions on request at any time. The National Social Party supports repealing the 2007 Health of Women act.

Abortions for rape, incest, risk to life, or fetal defects are constitutionally protected.

Legislation

The Health of Women Act allows for the termination of a pregnancy in Gjorka under the following sections:

  • under section 3, where there is a threat to the life of the women
  • under section 4, during the first twenty-six weeks if the pregnancy was caused by rape or incest, or if the fetus has significant defects
  • under section 6, during the first twelve weeks if conditions are no longer suitable for a future child
